Council affirms points, places Rocco’s Roadhouse on 12‑month probation after DUI‑linked incidents

The Nampa City Council affirmed the Alcohol Review Committee’s assessment of points against Rocco’s Roadhouse on appeal and placed the licensee on probation for 12 months after the committee found two DUI arrests of patrons were linked to the establishment.
Lieutenant Brad Childers of the Nampa Police Department summarized the incidents used by the Alcohol Review Committee to assess points. Childers said one arrest on April 11 followed a breath test reading 0.128 (or 0.125 on a repeat) after the subject had been at Rocco’s Roadhouse. A second arrest resulted from a blood draw that returned 0.289: “The blood results came back very high of a 0.289,” Childers said, noting that such a high level can require hospital transport and that the committee intended to send a message that DUI is taken seriously.
Owner Rocco Torres appealed the point assessment and addressed council in person. He said he watched eight hours of video of one patron’s visit and did not see drinking consistent with the resulting blood alcohol level. Torres described actions he has taken since the incidents: mandatory alcohol‑service retraining for staff, hiring a security guard, installing brighter parking‑lot lights, purchasing a portable breathalyzer, creating an informal volunteer driver pool and offering a “cab card” discount program to subsidize rides home.
Legal counsel told council the local code permits appeal if new factual evidence is presented or if procedural errors occurred; council heard Torres’ additional testimony as new factual material. After discussion, a council motion to affirm the ARC assessment carried on roll call. Council clarified the sanction: the two incidents had been assessed 3.5 and 2 points (total 5.5), and the license will remain on probation for 12 months from today’s action. Council did not impose a license suspension at this time.
Torres thanked council and told members he has implemented multiple operational changes and will continue steps to prevent intoxicated patrons from driving.
