Law Director and Acting Clerk John Wyckoff reported at the June 2 Forest Park City Council meeting that he will file a motion to dismiss on a jurisdictional standing issue in an appeal involving a marijuana dispensary.

"I prepared a motion to dismiss on the jurisdictional issue of standing. That will be filed tomorrow morning. It'll probably take a month for it to be briefed by the other sides," Wyckoff said. He added that the applicant in the underlying matter has intervened in the appeal to protect its financial interests.

Wyckoff also reported housing-code issues at Metropolitan Housing in the city, noted a basketball hoop left in the public roadway and said he had issued an opinion about the city's ability to access an applicant's financial and tax information for a potential development. He did not announce any formal enforcement actions or litigation filings beyond the planned jurisdictional motion in the dispensary appeal.

Councilmember Clark asked for clarification about parties in the dispensary matter; Wyckoff explained that a competitor across the street (identified in the record as Story, represented by attorney Taylor Trout) had opposed the application and is participating in the appeal process. Wyckoff characterized part of the dispute as differing interpretations of six criteria in the municipal code used to grant conditional uses.

No new council vote was taken on these items during the meeting; Wyckoff's report described planned legal filings and administrative enforcement matters.
