Board approves outdoor alcohol and entertainment permits; trustees direct review of noise enforcement

The Village of Germantown village board approved a set of outside‑premise liquor extensions and outdoor entertainment permits for the 2025‑2026 licensing year, and directed staff to clarify noise‑enforcement procedures and whether more objective decibel standards are feasible.

The board unanimously approved outside‑premises license renewals and new requests to serve alcoholic beverages on patios and decks. The board also approved an amended outdoor entertainment permit schedule after trustees clarified that any amplified outdoor music must comply with the village noise ordinance and end by 10:00 p.m.

Trustees and staff discussed how the village enforces the noise code. The village attorney explained the licensing framework: a premises license authorizes on‑site sales; an outside‑premise extension permits sales outside the building; and a separate outdoor entertainment permit covers amplified music and other outdoor audio. The attorney said the village adopted an outdoor entertainment permit to make enforcement of noise components easier and to avoid the higher burdens involved with revoking a liquor license. He cautioned that establishing an objective decibel threshold raises evidentiary and training challenges and typically requires expert testimony and calibrated equipment to defend in court.

President Soderbergh said he would direct the village attorney to research what peer communities require and consult the Washington County district attorney's office regarding evidentiary standards and training. Trustees said that, in the interim, they expect businesses and neighbors to act in good faith and urged establishments to be good neighbors.

Specific approvals included an outside‑premise extension for multiple establishments and a separate approval for Big Sky Country Bar and Grill, which received substantial public support. The board approved an outdoor entertainment permit set that included annual and one‑time events; the board amended at least one request to reflect the village closing/noise time (10:00 p.m.).

Several applicants described their proposed layouts during public testimony. For Das Barrel Room, the applicant described a small triangular stage on the deck with speakers oriented toward the expressway and a lawn area used for passive activities; trustees confirmed the stage and primary amplification would be limited to the deck area.

Trustees directed staff to return with a report on how other municipalities handle decibel limits and what training/certification would be needed to rely on sound‑level meters for enforcement.
