Caswell County staff will draft and circulate a proposed amendment to a water and sewer services agreement originally executed in 1990 that governs service to the Pelham Industrial Park, county manager Scott Whitaker said, and he asked commissioners for a consensus to forward an agreed draft to the City of Danville for its consideration.
Whitaker told the board the packet included the original amendment and five subsequent amendments from 1992 to 1999 and that attorneys had raised concerns about termination timing and related rights. He said a proposed amendment was not yet fully written or vetted but that he expected to email a draft to the commissioners the following day. “That's not fully written and vetted yet, but...the idea was that, if we could at least get a consensus of the board that you like the direction of that amendment, we would then forward that to the city of Danville,” Whitaker said.
Commissioners asked procedural questions and the manager said he had discussed the matter with Danville’s manager and expected the city would present the amendment to its board. If county commissioners find the draft favorable, Whitaker said he would place the item for vote on the June 16 agenda.
No formal motion or vote to adopt amendments occurred at the meeting; the board provided consensus to review the draft when delivered and directed the manager to proceed with intergovernmental coordination and return the item for action at the next meeting.
