County allows developer to start Roebuck Lane construction at their risk, subject to inspection

Walkers County Commissioners Court on June 2 granted contingent approval allowing New Era with Development LLC to begin construction on an initial section of Roebuck Lane in Railroad Place Section 3 before the final subdivision plat and construction plans are finalized.
County staff said the developer may start work “at their risk” and that the county would inspect construction as if it were being installed under the final plan review. Staff and the developer agreed that if final plans change after the work begins, the developer would be responsible for any necessary corrective work. The court moved and seconded the request and carried the motion.
The developer and county engineers said most changes remaining in the construction plans are minor and that the road location was unlikely to change. Staff described earlier drainage and culvert repairs and a hydrology rework that led to revisions in the Section 3 plans; the developer said it had addressed drainage, installed many pieces of infrastructure and was closing in on remaining plan edits. Commissioners emphasized that starting construction early would not allow the sale of lots prior to final plat approval.
The court approved the developer's request to issue a permit for the first road segment, with the developer accepting responsibility if later plan revisions require modifications.
