Smyrna authorizes resolution to allow legal action if Cobb County, Mableton dispute persists

The City of Smyrna voted to adopt Resolution 2025-011 authorizing the city to seek legal remedies if Cobb County and Mableton fail to reach a service delivery strategy agreement that affects Smyrna.
Miss Robinson explained the resolution was a contingency: “this is authorizing, in the unlikely event that we need it, authorizing all Smyrna to be involved in a lawsuit that would ask the court to stay any sanctions that would be imposed because of the failure of Mableton and Cobb County to enter into a service delivery strategy agreement.” She added that, as of that day, she had heard an agreement between the two jurisdictions was likely but the resolution would allow the city to ask a court to withhold sanctions “while Mableton and Cobb continue to negotiate.”
The motion to adopt the resolution was moved by Mr. Welch and seconded by Miss Wilkinson. The council used a hand vote; the clerk recorded the motion as passing 4-0. No amendments or additional conditions were recorded on the record.
Council members framed the resolution as protective and precautionary rather than immediately adversarial. The resolution authorized the mayor to sign and execute related documents should the contingency occur; no legal action was initiated at the meeting.
