He told the council the acquisition would secure 0.029 acres of fee simple right‑of‑way and about 3,200 square feet of temporary construction easement (plus an additional temporary easement area listed), and he gave a fair‑market impact value of $51,800.
Del Ross said staff has contacted the property owner, Fulton Greens Limited Partnership, and that the city sent a 10‑day letter two weeks earlier; the owner responded last week. He said condemnation authorization does not end negotiations but allows the project to proceed if a negotiated settlement cannot be reached; staff anticipated filing by the end of the week if a settlement is not reached.
Council member Carol Cookerly moved approval and Council member Verhoeff seconded; the council voted unanimously to authorize the condemnation action to secure the right‑of‑way for the roadway improvements.
