Commissioners correct zoning map error for 3800 West Constitution, approve scrivener’s-err ordinance

Monroe County commissioners voted 3-0 on May 29 to approve Ordinance 2025-17, a scrivener’s correction that restores a 2022 rezoning for a parcel at 3800 West Constitution Avenue.
Commissioner Thomas moved to approve the ordinance correcting the mapping error; the motion was seconded and passed on a roll-call vote of three yeses. Commissioner Thomas called the roll: “Commissioner Thomas? Yes. Commissioner Jones? Yes. Commissioner Madera? Yes.” The clerk announced the motion approved 3-0.
Planning staff member Ms. Nestor Jelen told the board the parcel was rezoned from PUD to LI in 2022 but the county’s CDO map had mistakenly reverted the parcel to PUD. She said county legal advised correcting the map via a new ordinance that references the 2022-01 rezoning ordinance to restore the intended zoning.
Ms. Nestor Jelen also briefed commissioners on two Community Development Ordinance text amendments staff intends to return with on June 5. She said one set of edits corrects scrivener and formatting errors and that the planning commission approved those corrections 7-1. She described a second amendment addressing the impervious-cover maximums, saying the change responds to the number of variances the county has been processing and that staff developed revised standards in consultation with the stormwater program manager and the drainage board; she said the planning commission approved that amendment, describing the vote in the transcript as "6 to 6 to 0." Ms. Nestor Jelen said the impervious-cover changes are intended to reduce the number of variances needed to process development proposals under the CDO.
No public comment was offered during the work session on the scrivener’s correction. Commissioners directed staff to return June 5 with full packets on the two CDO text amendments for formal consideration. The scrivener’s-err correction at 3800 West Constitution Avenue takes effect following the ordinance approval recorded May 29.
