Commission reinstates conveyance plat approval for Custer/Highway 190 amid condemnation proceedings

The Plano Planning and Zoning Commission voted unanimously June 2 to reinstate approval of a conveyance plat for a transportation and utility structure facility on about 2.9 acres at the north side of State Highway 190 west of Custer Road.
John Kim, senior planner with the planning department, told the commission that the planning department had approved the conveyance plat on Oct. 31, 2024, but that approval expired on May 1, 2025. Kim said the property is undergoing condemnation proceedings and the applicant — the North Texas Municipal Water District — requires more time to complete that process. Kim said city departments including Plano Fire Rescue and engineering had reviewed the plat and had no objections to reinstatement.
Under the subdivision ordinance, Kim noted, section 3.4 allows the commission to reinstate approval within 60 calendar days following the lapse of approval; staff recommended reinstatement. Commissioner Lingenfelter moved to approve the reinstatement as recommended by staff; Commissioner Bender seconded. The motion passed 5-0.
Commissioners asked staff whether the six-month reinstatement would be sufficient and whether there were guarantees the conveyance could proceed before any further lapse. Staff said they had not received a firm timeline from the applicant and that condemnation timelines vary; if the applicant has not finished within the reinstatement period, the applicant may return and request another reinstatement or extension and the commission would deliberate at that time.
