The measure, sponsored by Councilor Taylor, sets limits on the percentage of homes in a subdivision that may be used as non-owner-occupied rentals and creates a registration and permitting framework for landlords. Mayor Finkem said the administration will "operationalize this ordinance" and noted the council provided a six-month window for implementation.
The ordinance drew sustained public comment before the vote. Gabe Paul, president of the Westins Homeowners Association, told the council his neighborhood supports the proposal and said residents have seen a "proliferation of renters." Dave Javetsky described what he said were quality-of-life problems after a nearby house was converted to a rental, including blocked sidewalks, late-night noise and unshoveled walks. "We are very much in support of the current proposal before the council to enact a cap and registration ordinance," Javetsky said.
Other residents who spoke urged caution or changes. Jordan Cole, a renter, said renters contribute to the community and warned the ordinance could reduce rental options and push rents higher: "I'm opposed because I'm concerned about how it will affect our rent and the rent of future residents who might also bring value to this community." Several speakers representing neighborhood HOAs said amending private covenants can be difficult and praised the council for pursuing a city-level approach.
Council discussion included negotiated changes and at least one amendment during the meeting. Councilor Joshi successfully moved to expand the ordinance's family-member exception to include siblings and certain descendants. Councilors and staff discussed scope questions, including how the measure applies to older platted neighborhoods without homeowners associations; city legal staff said the ordinance's definition of "subdivision" covers platted neighborhoods of 10 or more single-family lots.
Mayor Finkem emphasized operational uncertainty and implementation costs. She said that while the administration will manage city staff to carry out the ordinance, "we will be back before the council with an appropriation request when the scope of implementation is better understood," including a decision about a statutorily allowed $5 registration fee.
The council and staff repeatedly distinguished the ordinance's land-use and planning intent from code enforcement. Several councilors said code enforcement tools and higher landlord standards will be needed to address maintenance complaints, while the ordinance itself is designed to preserve a balance of owner-occupied housing in single-family neighborhoods.
The ordinance leaves certain details to subsequent administrative action and rulemaking. Councilors said they view the passage as the beginning of an iterative process that will be refined as the city collects registry data and tests implementation.
The vote to approve the ordinance was 9-0. The text will now move to the steps needed for implementation by the mayor's administration and city departments; councilors indicated they expect follow-up budget requests and potential future amendments.
