Commissioners approve $278,000 easement sale for jail communications tower; funds to go to EPICS fund

Marshall County Commissioners voted June 2 to approve documents authorizing the sale of a perpetual easement and assignment of an existing lease for the communications tower located on jail property, with a purchase price of $278,000 to be deposited into the county’s EPICS fund.
County Attorney Sean Cerisi explained that the Marshall County Holding Corporation, a separate county entity that owns the jail property, intends to assign an existing lease to a different company and sell a perpetual easement for the tower site. Cerisi said he had negotiated edits to the buyer’s documents and recommended approval. “Essentially, it would be a purchase price of $278,000 … I think we have the documents at a place that I’m comfortable with and recommend to you for approval,” Cerisi said.
Cerisi and commissioners discussed timing: the Holding Corporation will consider the documents at its next meeting (the board meets infrequently), and the commission was asked to authorize the county president to sign so closings could be scheduled. John Bullock, county ethics coordinator, attended and noted the funds would go into the EPICS fund and could be used later for communication upgrades countywide.
A motion to approve the agreement between Marshall County, the Marshall County Holding Corporation, and AIO Operating 2 LLC for $278,000 carried by voice vote. The agreement authorizes the Marshall County Holding Corporation to execute the sale and instructs county staff to deposit proceeds into the EPICS fund and pursue upgrades to county communications as identified.
Ending: Commissioners approved the document package and authorized signatures; the Holding Corporation will complete its required action at its next meeting and the county will receive proceeds to the EPICS fund for potential communication upgrades.
