The Zoning Commission postponed action on a request from Florida Rock Properties Inc. for a 10-year time extension and a waiver of Subtitle Z’s two-year limit for the marina portion of a multi-phase PUD (case 04-14I).
Michelle (Office of Zoning staff) told the commission the applicant is asking for a 10-year extension to file a building permit for the marina design-review portion, moving the deadline to May 26, 2035, and a commencement date of May 26, 2036; the application included a waiver request to exceed the usual two-year limit under Subtitle Z §705.3(a). OP recommended approval but commissioners raised concerns about the length of the extension.
Commissioners said 10 years is an unusually long period and expressed concern about long delays in activating a public pier and waterfront access that are part of the project’s public benefits. Some commissioners suggested a shorter interval (for example, five or six years) and asked the applicant to return with additional information about phasing, public access improvements already completed, and ANC feedback.
Commission counsel and staff proposed a schedule: applicant to provide the requested responses by June 4; the applicant should work with the ANCs and parties to solicit input and the ANCs could file by 3 p.m. on June 11; the commission placed the matter on the agenda for the June 12 meeting. Counsel said the commission could defer to the next meeting after receiving the additional material. No final vote was taken at this session.
