The Lutheran Zoning Board of Appeals on a vote approved a variance that will allow Adam O'Doherty, of 20 North Maple Street, to construct a front-yard fence higher than the 3-foot limit in the city's zoning rules.
The variance was sought as a continuation from a prior meeting. O'Doherty told the board he submitted an updated plan with measurements and said he had letters of support from the two neighboring houses on the street. The board noted that its traffic safety officer had inspected the site and "did not see any issues with the sight lines," according to the officer's communication to staff.
Board members asked questions about the measurements and the location of support letters. After discussion, a board member moved "to approve the variance based on the shape of the lot." The motion was seconded and carried. The chair instructed the applicant that "a decision needs to be prepared and filed by the city clerk's office," and that there is an appeal period before any building permit issues; the clerk's office typically prepares the decision in about a week.
The board and staff did not announce a specific hearing date for any appeal; applicants were told to contact city staff, specifically Mr. Vincent, with questions about timing.
The vote and the board's direction mean O'Doherty may proceed after the appeal period expires without a challenge and once any required permits are issued.
