Committee staff told the Legislative Committee on Administrative Rules on May 15 that a rulemaking-authority chart created in 2023 will help the committee monitor which agencies have mandatory or discretionary rulemaking duties, statutory deadlines, and the status of outstanding rules.
Staff said the chart, initially prepared by Anthea before her departure, lists the year of a bill, act number, bill sections that create rulemaking authority, the topic, committees of jurisdiction, adopting agency, whether the authority is new, and whether language in the statute requires adoption by a certain date. The chart also notes when the committee or an agency has assigned tasks such as studies or statutory repeals.
Committee staff told members they plan to update the chart to include 2025 session activity and to present an updated version at the next meeting; staff recommended committee discussion about whether legislators want to use the chart proactively to contact agencies that are late in rulemaking or to rely on the committees of jurisdiction for enforcement and oversight.
Staff said the chart was intended to help the committee and legislators know what rulemaking to expect and to provide a basis for follow-up after session. The committee scheduled the next meeting and staff said they would circulate the updated chart in advance.
