Board extends Milestone Contractors' reclamation deadline; neighbor conditions noted

The Tippecanoe County Area Board of Zoning Appeals voted May 28 to grant Milestone Contractors LP a second five‑year extension to complete reclamation of a former pit north of State Route 25 (Hoosier Heartland) east of County Road 500 East. The site address in the record is 3961 and 3965 North 500 East.
Nathan McBurnett, APC staff, said the original special exception was granted in 2009 and modified in 2020. The most recent modification changed a planned pond fill to full backfill because the pond did not hold water. McBurnett recommended approval of the extension with a condition that the petitioner submit updated bond information at $3,000 per acre for the 14.783‑acre site.
Kevin Riley of RTS Law, representing Milestone, and Doug Pierce of Milestone told the board the hole is “over 50% full” and that there will be no change in hours of operation (7 a.m. to 7 p.m. weekdays with occasional Saturdays). They said no new mining will occur and the reclamation will be completed no later than Dec. 31, 2030.
A nearby resident, Dan Fleming of 3711 North 500 East, spoke in favor of the extension but asked two conditions of Milestone: limit late‑night tailgate or equipment noise and slow tri‑axle trucks to reduce dust. Riley said Milestone is “fine with what’s requested” and will work with the neighbor.
Because one board member recused from this vote, six ballots were cast; the clerk recorded six yes votes and the special exception extension passed. Staff’s recommended bond condition will be required before the extension becomes effective.
