Council hears first reading to clarify subdivision improvement requirements and developer participation

Steve Bargh, city administrator, presented a first reading on May 20 to amend section 19-63 of the municipal code to clarify subdivision-improvement requirements, developer obligations and the conditions under which the city may participate in infrastructure costs.
Bargh said the ordinance clarifies that newly created lots must have specified improvements and sets expectations for who pays for those improvements. The ordinance would allow the city to participate financially in required infrastructure only through a development agreement and gives the Board of Public Works and the council authority to waive required improvements in defined circumstances.

Bargh explained the changes are partly housekeeping but include substantive items: the code will explicitly require necessary street, sewer and water improvements for newly created lots; waivers could be granted by the Board of Public Works and the council (for example, where ditch streets are allowed instead of curb and gutter); and any developer assistance must be spelled out in the development agreement.
