The Butte‑Silver Bow Council on May 28 moved a resolution to final reading authorizing the sale of a two‑acre parcel north of Ramsey School to School District No. 3 for $15,500.
County Attorney Andrew Enruth told the council that the city of Ramsey had requested the two‑acre parcel so the district could expand the school; Enruth said current structures on the property were “very old mobile home structures, basically, essentially, tin cans that are housing students that they're teaching out there.”
Commissioner Bill Anderson asked whether the resolution included a clawback provision. Enruth pointed to language on page 2 that conditions the conveyance on the district’s use and states that “the property will be conveyed back to the city‑county should School District No. 3 choose to sell the property.” Anderson said he wanted the clause “to protect all the parties involved” and pressed about the sale price and whether it could be lowered for the school; Enruth replied that the $15,500 price had already been agreed through the land sales process.
Commissioner Dan Callahan asked whether the clawback included a timeline for when the district must build or use the land; Enruth said there is no time frame in the clause because the district may need time for funding and planning, and that the clawback applies only if the district later decides to sell the property.
The council approved moving resolution 2025‑28 to final reading and later passed the motion on final reading by a 5‑0 vote. The resolution authorizes conveyance of the specified parcel of surplus parkland property in the Ramsey townsite and includes the sale price and the conditional reversion (clawback) clause.
