The Redevelopment Commission voted to accept conveyance of three Eastgate parcels from the city after amending the draft resolution to remove language that made the transfer expressly dependent on completion of a satisfactory Phase I environmental assessment. Commissioners also approved paying for two appraisals required by Indiana code and authorized appraisals and environmental assessments for additional downtown parcels.
RDC staff explained the process: once the RDC accepts the parcels, state law requires two appraisals before the property is offered for sale; appraisals already have been ordered and staff asked the RDC to cover the appraisal cost of $3,300 from the consolidated TIF fund. The commission approved resolution 2025-326 not to exceed $3,300 for two appraisals for Eastgate.
Commissioners then considered parcels along the Banks of the Eel and amended a second appraisal resolution (2025-327) to add a third parcel to the appraisal list; that amendment was approved and the amended resolution passed. The commission also authorized a Phase I environmental site assessment (ESA) for the three Banks parcels, accepting a quote (resolution 2025-328) not to exceed $22,750 (the minutes show the figure discussed as $22,750, with the final board action recorded as “not to exceed $2,750” in the packet language; staff explained the ESA pricing and the need to do all three lots to avoid later rework).
On Eastgate, staff said the city had agreed to pay utilities for the remainder of the year if the property transfers before the city’s budget year; staff will request appraisals, advertise an RFP and, if needed, include covenants protecting tenants such as Braves restaurant parking. Commissioners and staff discussed liability and whether Phase I assessments should be performed before or after acceptance; staff recommended initiating Phase I work but finishing it with the developer’s entity name once a buyer is identified because Phase I protections run for a limited window.
Votes and next steps: the RDC approved the Eastgate acceptance (with the clause removed) and passed the appraisals resolutions. Staff will move forward to collect appraisals, order the ESA for the Banks parcels and prepare RFPs once appraisals are complete.
Ending: staff said they will coordinate with the city on any necessary amendments to the city council’s prior resolution to align transfer language and will return to RDC with appraisals and a proposed RFP schedule.
