Council denies short-term rental appeal for 108 Hale Street, 4-1

Fredericksburg City Council denied an appeal from the owner of 108 Hale Street seeking restoration of an STR-facility permit after staff identified a missed transfer deadline.

Staff told council that under the city’s 2024 STR ordinance a permit transfer is required within 90 days of a sale; the property sold Nov. 8, 2024, and the transfer application was not completed. The new owner said he had been working overseas as a Department of Defense contractor and relied on a realtor for procedural details. He testified he visited City Hall in April to renew permits after learning the expiration date was in May.

“...I came in April because I knew it's gonna be expired. But I realized that I missed the time frame of 90 days,” the applicant said while describing efforts to coordinate remotely and hire local contractors for repairs and furnishings.

Staff said the property had two STR units and had been a legal nonconforming STR facility under prior permitting, but the STR ordinance requires conformity with current zoning and transfer procedures after a change in ownership. Staff also noted extenuating circumstances and submitted supporting documents related to the owner’s military/DOD service.

Council members debated whether the owner’s overseas service constituted sufficient grounds to restore the permits. Several members voiced concern about setting a precedent that could encourage other late-transfer appeals; others noted the applicant’s military-related circumstances. At the conclusion of debate, council voted 4–1 to deny the appeal.

Council directed no further action at this meeting; staff did not reinstate the STR permit. The owner was told he may operate the property as a long-term rental and must comply with applicable city rules for that use.
