The Lynn Zoning Board of Appeals voted unanimously May 20 to extend the period for Neighborhood Development Associates Inc. to exercise a zoning variance for 38 South Commerce Street, moving the deadline from June 6, 2025, to Dec. 6, 2025.
Neighborhood Development Associates Inc., represented in the hearing by attorney James D. Moore (as named on the case filing), requested the extension under Massachusetts General Laws, chapter 40A, section 10. Jeff Wheaton, who identified himself at the meeting as appearing on behalf of the project team, told the board the project — described at the hearing as a veterans housing project at the former armory site — needed extra time to “get the funding in place” and to finalize tax-credit syndication and due diligence.
The variance-extension request was made during the Zoning Board’s regular meeting. A motion to extend the deadline was made and seconded; the board then conducted a roll-call vote. Members voted in favor of the extension (roll-call recorded as: Member Maggio — yes; Member Christopher — yes; Member Olsen — yes; Member Krowitz — yes; Member Lopez Hernandez — yes). The chair closed the item after the vote.
Under chapter 40A, section 10, applicants may seek extensions to exercise a variance; the board’s action leaves the original variance in place while giving the developer additional time to close financing and other conditions the petitioner described. The petitioner said a syndicator has provided a letter of intent and the team is completing due diligence and loan/credit arrangements.
Board members did not add additional conditions on the extension during the roll call recorded at the meeting. No public comment for or against the extension was recorded on the transcript.
Next steps for the project are administrative: the petitioner may proceed with financing and permitting work during the extended period and must comply with any building- or permitting-conditions attached to the original variance or other municipal approvals.
