During the second reading, the council voted to vacate the alley; the clerk's roll-call showed affirmative votes and the chair announced, “Motion carries.” After the council enacted the ordinance, a nearby resident, Tanya Hill, asked when she could proceed with building a fence or other improvements on the vacated area.
Tanya Hill asked, “The question I have is once we this is completed, at what time frame can we proceed with, like, building on that like, putting a fence and things of that nature?” City staff responded that property owners may build immediately but must remain aware of any recorded easements for utilities that would still allow city or utility access. Staff also reminded Hill that a city permit is required for such improvements and that if utility work is needed in the future the property owner may be required to remove or alter the improvement.
The transcript indicates the council did not attach additional conditions to the alley-vacation ordinance on the record. The city will continue to enforce permitting requirements and any recorded easements even after the alley is vacated.
