Attorney Todd Pressman presented the request and explained the parcel’s history: the original lot’s irregular shape and a certified parcel application submitted in 2021 led to the current folio configuration. Pressman argued the flag‑lot configuration followed the existing parcel geometry and code constraints for frontage and lot size and therefore presented a unique, non‑self‑imposed hardship.
Planner Joseph Rainbolt explained the LDC rule: a flag lot may be created only in the rural area and in agricultural zoning unless a variance is granted. County staff said the parcel subdivision process remains incomplete and that the certified parcel submittal includes outstanding comments; staff did not report opposition or major outstanding policy issues in the hearing record.
The hearing officer asked about recorded deeds and the certified parcel status; Marshall confirmed the certified parcel submittal had outstanding comments and had not been approved. The applicant said no structures currently exist on the new flag lot and that the proposal would create a single additional single‑family parcel with one access to Pearson Road. No public speakers reported opposition at the hearing.
The hearing officer closed testimony; the land use hearing officer will issue a written decision on Variance 25‑0638 within 15 business days.
