Commission recommends interim use permit for Flint Hills warehouse tent at Pine Bend refinery

The Rosemount Planning Commission on May 27 recommended the City Council approve an interim use permit (IUP) for Flint Hills Resources to construct a temporary warehouse tent at its Pine Bend refinery, finding the request consistent with prior temporary-structure approvals on the site and with zoning setbacks.
Staff said the proposed tent is similar to temporary warehouse structures and blast-resistant modules previously approved under a 2019 IUP and located inside a ‘‘blanket agreement’’ area established between the city and Flint Hills. Anthony (city staff) told the commission staff recommends the new IUP expire on the same date as the existing permit to simplify future renewals, and listed six conditions carried over from the existing permit, including a 300-foot setback from Rich Valley Boulevard and payment of property taxes based on structure valuation.
The item drew no public speakers during the hearing, and commissioners voted to forward a recommendation for council consideration on June 17.
Why it matters: the request permits a temporary structure within an industrial refinery site under a previously negotiated blanket agreement area; aligning expiration dates with the existing IUP reduces the number of separate renewals the city must process.
Staff presentation and findings: Anthony told the commission the proposed semi-rigid warehouse tent would be sited in the southern portion of the refinery property within the expansion area added to the blanket agreement in 2014. The tent has roof trusses and end elevations similar to other temporary structures already on-site. In order to approve an IUP staff said five findings in the zoning ordinance must be met; staff concluded the proposed tent meets the purposes of the comprehensive plan and zoning ordinance, will not detract from nearby character or traffic, and conforms to district regulations and setbacks.
Noted conditions and clarifications included aligning the new IUP’s expiration with the existing 2019 IUP (staff said 2029 as the expiration year), limiting the tent to the blanket agreement area (which allows some flexibility for Flint Hills to relocate temporary structures inside that area without returning for approval), requiring the tent be kept more than 300 feet from Rich Valley Boulevard, and requiring the applicant to pay property taxes on the structures rather than seeking valuation waivers from the county assessor.
Action and next steps: Commissioner Reid moved and Commissioner Bugai seconded a motion recommending the City Council approve the interim use permit subject to the six conditions in the staff report. The motion carried unanimously. The item will move forward to City Council on June 17 for final action by the council.
