Springfield City Council authorizes continued CLF representation and appeal to SJC in Palmer Renewable Energy case

The Springfield City Council voted May 27 to authorize continued legal representation by the Conservation Law Foundation and to pursue an appeal to the Massachusetts Supreme Judicial Court in the matter of Palmer Renewable Energy LLC versus the Zoning Board of Appeals of the City of Springfield, appellate case number as read in the meeting (2024‑PD‑0136).

Councilors first moved into an executive session to discuss litigation strategy under the open meetings statute cited during the meeting. "Mister president, I'd like to make a motion to go into executive session for the purpose of discussing a strategy with with respect to litigation pursuant to to the open meeting law. Mass General Laws, Chapter 38, Section 20 one(three) in connection with an order authorizing the continued legal representation of the city council and its individual members by the Conservation Law Foundation in the matter of Palmer Renewable Energy LLC versus the Zoning Board of Appeals for of the City Of Springfield, et al, Massachusetts Appellate Case number 20 24 e dash 0 1 3 6," said Councilor Allen.

The council reconvened in open session and, after what the presiding councilor characterized as lengthy discussion, held a roll-call vote authorizing the appeal to the Supreme Judicial Court. "We are now back in open session, counselors. We've discussed at length the potential for appealing this case to the SJC. If there's no further discussion, then we can have a roll call vote, authorizing the appeal to the SJC," the presiding councilor said. The clerk called the roll and the presiding councilor announced, "More than sufficient. Order passes." The meeting record does not disclose the contents of the executive session.

The order on the agenda both authorized the continued legal representation of the City Council and its individual members by the Conservation Law Foundation and explicitly authorized pursuing an appeal to the SJC in the identified appellate matter.
