County Attorney Boyd explained the legal basis for holding deliberations in executive session under the New Mexico Open Meetings Act, citing exceptions for deliberations in connection with adjudicatory proceedings and threatened or pending litigation. He told the board the closed deliberations were limited to process and procedure and not to merits or final decisions on the application.
Commissioners emphasized the closed session was to allow the board to discuss the procedural approach to the adjudicatory matter and to plan the public process. After returning to open session, the board moved to adopt an order consolidating the appeals, recognize parties with standing, allow interested parties to apply for standing by June 10, and set the June 17 special meeting as the next procedural step. The board clarified the June 17 proceeding is a prehearing step and not the final merits hearing, which will be scheduled later.
