The Roswell committee on May 27 authorized the mayor or city administrator to approve the sale of small city-owned right-of-way along Shallowford Road and Hightower Road where a private builder's decorative fence and columns encroach on city property.
Staff told the committee the developer agreed to pay $5,000 for the right-of-way, and that the combined area under consideration is small — "less than 200 square feet," according to staff presenting the item. The sale was described as a way to remove the city's ownership and associated liability for the encroaching structures. Chief Legal Officer David Davidson reviewed the matter with staff, the presenter said.
Motion to authorize the sale was made by Councilmember David Johnson and seconded by Councilmember Orland; the motion passed unanimously.
Staff said they had discussed the encroachment with the builder and reviewed city plans and found the specific portions of right-of-way proposed for sale would not affect future multi-use trails or other planned infrastructure. City staff referenced a series of meetings with the builder and noted Jackie (a staff member) had been involved in the detailed work on the file.
The committee's authorization allows the mayor or city administrator to complete the sale process; staff said further administrative steps, legal review and recordation would follow as part of the conveyance.
