The Pennington County Planning Commission on May 27, 2025, approved preliminary plan COPPL25-0002 allowing the division of a 12.57‑acre parcel at 24101 Highway 16A into two lots: approximately 7 acres and roughly 4.5 acres.
Cody Saxinger presented the application on behalf of applicant and landowner Gary Mitchell, and said the property is currently zoned agriculture but was approved for rezoning to rural residential by the Board of Commissioners on May 6, 2025. Saxinger said two unpermitted sheds and an existing shop on the property must receive approved building permits before the plat can be filed; staff communicated this requirement to the applicant and agent.
Staff also noted that registered deeds required a plot heading adjustment, which was added as a condition of approval. The applicant dedicated a 66‑foot easement; staff explained the easement line ran through a shed on earlier plans, so the easement was adjusted to lie outside the structure. Saxinger told commissioners the request appears in harmony with surrounding lots and land uses and recommended approval of the preliminary plan with stated conditions.
A commissioner moved to approve COPPL25‑0002 with two adjustments to criteria (changing criteria 8 and 11 from “no” to “yes” to reflect corrections); a second was given, the commission voted and the motion carried.
