The Pennington County Planning Commission on May 27, 2025, approved conditional use permit COCU25-0010 to allow a multiple‑family dwelling at 10900 Nemo Road, a property owned by Jerry and Arlene Litzel.
Megan Tallmadge, planner, said the site is in an Agriculture District near the county border with no flood hazard. Staff reviewed the application against seven conditional use criteria and received two interdepartmental comments: the second dwelling needs posted addressing on the structure and where the driveway meets Nemo Road, and the applicant must obtain an approach permit from the county highway department because none is on file.
Tallmadge told commissioners that when the applicant applies for a building permit they must provide a fully completed building permit application, an approach permit from the Highway Department and an on‑site wastewater treatment system installation permit for the two new bedrooms. The commission asked about density; Tallmadge said density is low in the area, which is mostly U.S. Forest Service land and large‑lot agriculture. County highways staff indicated they are unlikely to grant a new approach and the property will likely have to use the existing approach.
A commissioner moved to approve COCU25‑0010; a second was given, the commission voted and the motion carried.
