The Seven Hills City Council confirmed a zoning-board-approved variance for a property owner at 837 Dartmoor Avenue to install a vinyl fence 32 feet forward of the rear building lot line on the east side of the lot.
Zoning Board Chair Stacy Kelly summarized the May 14 zoning meeting: the applicant sought a 32-foot variance from codified fence and wall regulations (Ordinance 931.04(b)(6)) to allow the fence placement. The applicant described concerns about animals cutting through the yard, damage to vegetation and an irrigation system that would conflict with a fence placed without the variance. No residents testified for or against the request at the zoning meeting. The engineering comments recorded at the zoning meeting stated the proposed fence would be behind the house front setback and would not create a site-distance limitation.
The zoning board voted 4–0 to approve the variance with one member abstaining because of neighborhood proximity. Councilman Snitsky presented the zoning-board report and moved to approve the variance on the council floor; after brief confirmation, the council voted to grant the variance.
Council discussion on the floor was minimal; one member noted prior ordinances have allowed similar access-to-side-door variances. The council record shows the board vote, the reasons provided by the applicant, the engineer's site-distance and property-line observations, and the council's confirmation of the variance.
