The Jacksonville Beach Board of Adjustments on May 20 approved multiple variances for 510 South Third Street to allow reconstruction of a two‑unit multifamily dwelling, but the board made approval contingent on the existing structure remaining in place.
Applicant’s agent Michael Sitner explained the property’s history: the building dates to 1948, was converted at some point to five multifamily units without clear permits, and now the new owner proposes converting it back to two units and bringing the property into compliance. “My client is looking to do 2 multifamily units which is a conditional use under the zoning and proposes no exterior changes,” Sitner said.
The variances requested included reduced side yard setbacks (1 foot in lieu of 10 feet per side), a reduced rear setback (9 feet in lieu of 20 feet), reduced parking area setbacks and landscaping waivers. Before the hearing, staff reviewed an updated survey and confirmed paved parking will be provided; staff indicated support for the project given the existing nonconforming conditions.
During discussion a board member moved to approve the variance with an amendment that the variances apply only while the existing structure remains; if the structure is torn down the variances would no longer apply. The amendment and final motion passed unanimously. The board’s condition ties the relief to the present structure and requires the owner to follow normal permitting and building code processes.
