At a special session of the Fayette County Commission, members voted to hold decisions on dissolving Kanawha Falls, Page Kinkade and Armstrong Creek public service districts and to delay execution of a proposed asset purchase agreement (APA) with West Virginia American Water until the commission’s June 11 meeting. The commission also approved the appointment of Robert Scott to the Canal Falls Public Service District.
Michael, a county staff member who briefed the commission on the process, said the county was still finalizing negotiations and recommended the commission “hold decision in abeyance” until the APA is finalized. He told the commission an amended order would be prepared to align statutory timelines with the June 11 date.
The commission moved, seconded and approved motions to: 1) hold decisions on the PSD dissolutions until June 11; 2) enter an amended order to align deadlines with that date; and 3) hold decision on executing the APA until June 11. The transcript records the motions being seconded and approved by voice vote (all commissioners present responded “Aye”). The APA text was placed on the meeting agenda for public information but was not signed.
Separately, the commission approved appointing Robert (Bob) Scott to serve as a commissioner for the Canal Falls Public Service District. The appointment was moved, seconded and approved by voice vote.
Commissioners and staff said the June 11 meeting is expected to include final documents and signatures if negotiations conclude as anticipated. The county staff briefing noted statutory timelines that require documented actions in order to preserve compliance; the staff-prepared amended order was described as a non-protracted administrative step to satisfy those timelines.
Next steps: the commission will revisit the PSD dissolution votes and the APA execution at its regular meeting on June 11, 2025, when staff expects to present finalized documents for potential approval.
