The Monroe County Plan Commission voted unanimously to forward a requested phasing-plan amendment (PUO-25-2) for Westgate on Third PUD to the County Commissioners, including a waiver of the final hearing and new language allowing limited administrative flexibility for weather-related construction delays.
Anne Krycilius (planning staff) explained the amendment changes only the PUD’s phasing narrative. The developer previously documented a multi-phase buildout with checkpoints, including completion of multiple bioretention ponds and final landscaping. Staff and the petitioner proposed added language that permits the administrator to issue a conditional land use certificate — valid up to six months, renewable once at the administrator’s discretion — when weather prevents completion of final landscaping or final stormwater infrastructure tied to a phase.
Krycilius said the petitioner and legal staff worked with stormwater staff to craft the language; Erica Pena, stormwater program manager, indicated stormwater supports the change so long as ponds are finished correctly rather than rushed. Stormwater noted the site’s ponds are functional and discharging as designed, and staff said the county already holds a letter of credit to secure incomplete stormwater infrastructure if necessary.
Ryan Huffman, project contractor for Sunstone Construction, said the team had made recent progress (pond 3A underdrain installed and amended soils placed) but that Pond 4 is large and continued wet weather had delayed final completion. After no public comment, the commission forwarded a favorable recommendation to the County Commissioners and approved the waiver of the final hearing.
