Commission approves rezoning of Old Selma Road lot with grocery-only condition

The Montgomery City Planning Commission approved a rezoning request for one lot on the north side of Old Selma Road, approximately 300 feet east of Trinity Road, changing it from R75 to B4 commercial zoning with a qualification limiting the site to a grocery store.
Derek Vincent, representing the property owner, told the commission he planned to operate a grocery store on the site. "I'm absolutely planning on [a] grocery store," Vincent said. Commissioners offered to include a qualifying condition (a "Q") restricting the permitted use; Vincent said he had no objection to a grocery-only limitation.
Commission staff noted the site's consistency with the city's Envision 2040 plan and the record included historical variances approved by the Board of Adjustments for earlier uses on the parcel. A motion to rezone the lot to B4 with a Q limiting the use to a grocery store was made, seconded and approved unanimously.
The commission's action attaches the qualifying use to the zoning change; minutes show the vote carried with no recorded dissents. Commissioners did not attach additional conditions beyond the grocery-only qualification during the meeting.
