Tumwater committee backs placing Herrera service agreement for stormwater nutrient plan on council consent calendar

The City of Tumwater Public Works Committee on May 22 voted to place a revised service provider agreement with Herrera for a nutrient-reduction enhanced maintenance plan on the June 3, 2025, City Council consent calendar with a recommendation to approve and authorize the mayor to sign.
The committee heard from city staff that the project will analyze current stormwater maintenance practices to help the city meet a dissolved-oxygen TMDL and new NPDES permit requirements, including expanded street-sweeping obligations. "The spatial analysis will help us identify hot spots for pollution and include land use and current stormwater BMP locations," staff said.
The presentation said the Department of Ecology grant agreement for the project was signed last month for $200,000 and that Herrera’s service provider estimate is about $190,000. "We selected Herrera based on two rounds of RFQs and their familiarity with our project management team; they are currently doing similar work for Bellingham and Tukwila," staff said.
Council members asked about unusual timing and contract language. "The timing was unusual because we had this teed up ready for them to sign, and then they kind of stuck this in at the very last minute," staff said. City staff member Karen told the committee the indemnification language in the revised agreement "is required by statute," noting the language differs from the city’s template but is legally necessary for the service being contracted.
The committee motion to place the agreement on the June 3 consent calendar carried with all present voting in favor.
Background: committee materials describe the work as identifying maintenance activities and resources needed to meet the TMDL and NPDES requirements, and to identify data gaps and street-sweeping needs. The project completion date in materials is approximately one year from award.
The committee took no other formal actions on the project beyond forwarding the revised agreement to council.
