The Eden Prairie City Council on May 20 voted to adopt a resolution vacating part of a drainage and utility easement associated with a property on Boulder Point Road and to approve a conservation easement over a portion of Lot 1.
City staff explained the vacation makes room for the homeowner to construct a pool. Staff said the conservation easement is being recorded now because it should have been included on the original plat of the development and was missed; staff also noted the conservation easement covers an on-site wetland.
During the public hearing portion of the meeting, staff invited public comment; no members of the public spoke. A councilmember moved to close the public hearing and adopt the resolution vacating the drainage and utility easement and the motion was seconded; the council approved the motion by voice vote and the measure passed unanimously.
Council members discussed briefly why the conservation easement had been missed at platting, with staff responding that the development was dated and administrative oversights can occur during periods of heavy growth. The council treated the item as routine and recorded no additional conditions beyond the conservation easement.
The resolution pending recording will alter the legal easement footprint on the property identified in the packet as Block 1, Boulder Ridge Addition, and is intended to preserve wetland area while adjusting the usable private yard area for the homeowner's pool construction.
