Committee clarifies TCEQ review‑panel process for disputes with groundwater conservation districts

Proponents said the bill answers outstanding questions about how panels access technical and legal assistance, how expenses are reimbursed, and how the panels’ meetings and records should be handled under the Public Information Act and open‑meetings requirements. Brian Sledge, representing several groundwater conservation districts, told the committee the changes “answer a lot of unanswered questions,” including how panel meetings are posted, how records are treated, and how members obtain technical and legal support.
Several groundwater district representatives said they support the House bill as passed by the House, but raised concerns about a later proposed committee substitute that would allow review panels to consider curtailments placed on wells used under TCEQ authorizations and would shift the burden of proof in some proceedings. Greg Ellis and Monique Norman cautioned the committee that one version of substitute language could have broad statewide consequences because it could extend review panel jurisdiction to a large number of TCEQ‑authorized entities.
Committee members asked staff and witnesses to refine substitute language; after discussion the committee adopted a committee substitute and voted to report the bill favorably to the full Senate by roll call.
