Representatives for 45 Dale LLC told the Town of Babylon Town Board on May 21 they are seeking to lift all covenants and restrictions placed on a Dale Street property in 1994 that had governed ownership and operational limits for a transfer station and recycling operation.
Attorney (identified in the transcript as) Schaffer, representing 45 Dale LLC, said the board previously removed two covenants in January and that the Planning Department and Planning Board later adopted additional covenants and restrictions on May 5, 2025. Schaffer said the applicant’s current filing asks the board to remove all remaining covenants and restrictions affecting ownership and related limits on use.
A nearby resident, Richard Francisco of 21 Ead Street, spoke during the open public comment portion and asked how reopening or expanded operation would affect traffic and whether a traffic study would be required. Francisco said he had received a letter about a facility reopening for recycling or garbage recovery and asked what would be in place if the facility resumed full operation.
Town staff and Schaffer responded that the property’s existing use for recycling/recovery remains, that current activity is minimal, and that the business is being sold to a new operator who plans to operate it much as it operated in the past. Schaffer said the facility would accept cardboard; whether bottles and cans would be accepted was not confirmed in the transcript. Schaffer told the resident that because the use exists on the property, the town was not expecting a new traffic study as part of this application.
No other members of the public filed cards. The board closed the public hearing and reserved decision: the motion to close was made by Councilman McSweeney and seconded by Councilman Gregory; the board responded “Aye” and the hearing was closed and decision reserved.
