The Board of County Commissioners approved a request to grant a utility easement across county‑owned road parcels in the Jordan Ranch area so utilities can be installed, maintained and removed where necessary to serve properties in the road network.
Patrick Swart presented background: when the subdivisions and surveys were filed decades ago, access and utility easements were not created on record for several road parcels that the county later acquired in tax sales. The request originated from a subdivision application (875 Hidden Treasure Court) whose applicants needed to demonstrate a utility easement to serve the property. Staff recommended granting an easement over the county‑owned road parcels to serve the broader road network.
A commissioner moved to approve a grant of a utility easement for the purpose of constructing, maintaining, altering, reconstructing, and removing public utility lines and related facilities across Missoula County property, citing tax deed records (volume 150, page 993 and volume 150, page 991). The motion was seconded and passed by voice vote.
Staff said the easement will affect multiple surveyed road parcels (identified by certificates of survey referenced in the presentation) and will clarify the ability to install utilities for this portion of the county road network. No public opposition to the easement grant was recorded at the meeting.
The county will record the easement consistent with the motion’s legal description and the County Clerk and Recorder’s records.
