City flags delays and payment holds on St. Michael’s construction; change order extends contract

City staff told the Biloxi City Council they are extending the construction contract for the St. Michael’s project and withholding portions of contractor payments after continued delays tied in part to CSX flagger availability and outstanding work.
A staff presentation said change order Item 5R extends the contractor’s contract time for the St. Michael’s work because CSX could not provide required flaggers. Staff said they will send a punch list to the contractor and give 30 days to complete the items; the contractor’s contract time will be suspended while the work is performed and then resume for the remaining contract days.
Staff also described problems tying homes and businesses into a new sewer main for project area BEA 1–3. The contractor, identified as Nikkei Brothers Construction Company, has not secured a subcontractor to line an old sewer main at Pinegrove and Highway 90; staff said the city has reduced the contractor’s monthly pay application by $145,000 because of issues at the Beauvoir pump station and other items pending correction.
City staff said they are holding retained funds and will not pay for installed work until outstanding design and construction deficiencies, including electrical/corrosion issues and sewer lining, are addressed.
The change order and related consent items were approved as part of the consent agenda at Tuesday’s meeting. Staff said they will continue to monitor the contractor’s progress and report back to the council.
