Special Magistrate Andre McKinney approved an abatement reducing a $121,100 code‑enforcement fine for Cobblestone 2 BNB LLC to $12,200 after the property manager asked for additional mitigation citing extensive permit activity and a seawall project.
Tenea Nichols, who identified herself as the property manager and later noted she is also employed by the City of West Park, told the magistrate the property owner had invested in a seawall and paid substantial permit fees. Nichols asked the magistrate to reduce the fine further and said, “the town itself has received approximately a 96,000 in permit fees just for the seawall” and that the project cost the company more than $1 million.
Magistrate McKinney said the town normally grants an 85% reduction in similar cases but approved a 90% reduction here, announcing the fine would be mitigated to $12,200 and must be paid within 30 days or the original $121,100 amount will be reinstated. McKinney said the reduction reflected the property’s compliance and “the betterment to the community” from the seawall project.
Nichols accepted the resolution in court. The order includes the $100 administrative hearing fee in the mitigated amount and requires payment or reinstatement of the original fine if payment is not made on time.
The magistrate noted his willingness to recuse if any party believed a conflict existed; he also recorded Nichols’s statement that her appearance was in a private capacity and not on behalf of West Park. The record shows the magistrate and the parties reached an agreement in the hearing and entered the abatement on the record.
