Beaver County RDA, commission approve corrected Milford Solar 2 project area after duplicate-parcel error

The Beaver County Redevelopment Agency and the Beaver County Commission approved amendments on May 20, 2025, to correct duplicated parcels in the Milford Solar 2 community reinvestment area, reducing the plan's acreage and adjusting the project's base value used for tax-increment calculations.
Jason Berningham, with LRB Public Finance Advisors and the financial advisor to the county and the redevelopment agency, told trustees that an internal review found duplicate parcel entries that “double counted some measure value numbers” and made administration and tax-increment calculations difficult. He said the original calculation showed about 4,339 acres; after removing duplicated parcels the amended plan reflects about 3,179 acres.
The board of trustees of the redevelopment agency approved a combined resolution to adopt the amended project-area plan and the amended project-area budget (identified in the meeting as Resolution 2025-08). The county commission then adopted Ordinance 2025-03 to accept the RDA’s amended plan as the official plan for the Milford Solar 2 community reinvestment area.
Berningham said the legal description of the project area was correct and that the error was confined to the parcel list attached to the legal description. He provided parcel identifiers for the duplicates during the presentation and said fixing the list removes the duplicated acreage and adjusts the base value used for tax-increment calculations.
On the question of public-notice requirements, Berningham said the 2021 expansion of Milford 2 had required a public hearing and 30-day notice to property owners, but that this particular correction—removing duplicated parcels from the list—did not trigger the same statutory hearing requirement and could be adopted with the routine agenda notice.
Commissioners voted to approve the RDA resolution and the county ordinance during the May 20 meeting. Commissioner Pearson abstained from voting on the county ordinance; other commissioners voted in favor.
The amendments change how future tax-increment revenues for the Milford Solar 2 project area will be calculated and are intended to make administration of the reinvestment area and its budget more straightforward. County staff said they will proceed with the updated project-area documents and the amended budget as adopted by the RDA and ratified by the commission.
The county did not present additional substantive project changes (such as new incentives or new parcels added); the action described at the meeting is limited to correcting the parcel list and associated base-value figures.
