Magistrate orders abatement and permits at Indian Road property after fire inspection found unpermitted work and unsanitary living conditions

City code and building inspectors testified that a property at 2269 Indian Road contained unpermitted electrical and plumbing work, makeshift canopies and temporary structures used as paint booths, and several dwelling areas lacking proper sanitary facilities. The special magistrate ordered the property owner or responsible party to remove or properly permit the installations and to abate unsanitary living conditions within 60 days or face fines of up to $100 per day.

The matter was brought to code enforcement following a fire inspection that revealed unsafe and unsanitary conditions. Ryan Brown, chief plumbing inspector, said the fire department referred the property after its inspection and that the site included “dwelling” trailers without proper bathroom connections, outdoor showers with gray water discharging to the ground, temporary canopy paint booths, and plumbing and electrical work lacking permits.

Brown told the magistrate that some temporary corrections had been made but that unpermitted work and makeshift installations remained. He recommended 60 days for compliance and argued removal of unauthorized structures might be the appropriate remedy rather than permitting in some instances. The magistrate accepted the city’s evidence and found the property in violation of FBC 110.3 and FBC 105.1 for failure to obtain permits for electrical, plumbing and temporary structures, and separately found unsanitary conditions under the code section cited for clean-and-sanitary violations. The owner or responsible party was ordered to bring the property into compliance within 60 days or face the stated fines; the order also authorized abatement by the city if the owner did not act.
