Kevin Pennington, a building inspector for the City of West Palm Beach, described his observations and the stop-work posting dated Feb. 12, 2025, and said the city recommends 120 days to comply and $50 per day after that. Joel Barrett, the property manager representing PBL Boulevard LLC, told the magistrate the fence permit had been completed and that HVAC and window/door permits were in progress. Barrett did not object to the city's recommendation for 120 days.
The magistrate accepted the city's evidence and found the property in violation of the cited Florida Building Code sections, ordering 120 days for compliance and warning of fines up to $50 daily thereafter. The magistrate also advised the respondent to stay in contact with the assigned code officer.
