House Commerce Committee votes to report S.69; adds AG rulemaking deadlines

The Vermont House Committee on Commerce and Economic Development on May 21 voted to report favorably on Senate Bill 69, draft 2.1, after the Office of Legislative Council briefed members on a small number of drafting changes and added rulemaking dates for the attorney general.
Rick Segal of the Office of Legislative Council told the committee that two kinds of changes were in the new draft: replacing the word “consumer” with “individual” in the prohibited data and design practices section and adding specific deadlines for attorney general rulemaking. “The attorney general shall on or before 01/01/2027 adopt rules that prohibit data processing or design practices, etcetera, etcetera,” Segal said, reading the new language into the record.
The committee discussion focused on clarifying the scope of the prohibition (whether it applies to Vermont consumers or any individual) and on aligning several effective dates. Segal noted the package sets the act’s general effective date at Jan. 1, 2027, while the two rulemaking provisions are written to take effect earlier so the attorney general can begin rulemaking: “the entire Act takes effect 01/01/2027, except those 2 rulemaking provisions that have that date of Jan 1, 20 27, actually take effect 07/01/2025,” he said.
Representative Duque seconded the motion to report the bill out favorably. The chair called a roll and the committee recorded affirmative votes from Representative Bosch, Representative Putin, Representative Caris Duncan, Representative Cooper, Representative Duke, Representative Nicholas, Representative Olson, Representative Friasley, Representative White, Representative Granny and Representative Markovs. One member (Kirk) was noted as not present at the time of the roll call.
Committee staff described next steps for filing: members agreed to provide a clean copy of draft 2.1 for posting and to notify the clerk that the committee is reporting S.69 out with a favorable recommendation and proposed amendment language.
The committee did not take up further substantive amendments to the bill during this meeting; Segal said the highlighted changes were largely drafting and date alignments and that the attorney general’s office must adopt rules by the Jan. 1, 2027 deadline if the bill becomes law.
A clean copy of draft 2.1 was to be circulated to committee members and the clerk for tomorrow’s proceedings.
