Lincoln, Nebraska — The Nebraska Legislature spent a daylong floor debate on May 21 considering LB 677, a bill and committee amendment that would create a statutory regulatory framework for medical cannabis, with senators sharply divided over whether to implement rules in statute or leave regulation to the newly created Nebraska Medical Cannabis Commission.
Proponents of LB 677, including several senators who sponsored or helped craft the committee amendment, said the bill provides needed guardrails to make the medicine accessible and safe. “If we’re gonna say it’s medical, we treat it like medical,” Senator Hansen said on the floor, urging a regulatory structure he called conservative and patient-focused.
Opponents argued the two voter-approved ballot initiatives (Initiative 4-37 and Initiative 4-38) vest the authority to regulate medical cannabis exclusively in the Medical Cannabis Commission and that the legislature should confirm the governor’s nominees and let that body write the rules. “The power to regulate all phases of the control of the possession, manufacture, distribution, delivery and dispensing of cannabis for medical purposes … is vested exclusively in the commission,” Senator Storm said, quoting the statutory language from the initiative.
