The Cumming City Council authorized the mayor to sign a corrective easement agreement to formalize the actual location of a wastewater outfall installed as part of the Byers Road project on property owned by M and B Precise Farms, LLC.
City staff explained that during construction of the Byers Road outfall, the utility alignment was shifted to a different portion of the property than originally planned. The property owner has already executed revised easement documents and the city has paid for the work; staff said the corrective agreement is an administrative step to record the change. The presenter told council the project is complete.
A councilmember moved to approve the corrective easement agreement and to authorize the mayor to sign; another councilmember seconded the motion. The council voted 4-0 to approve the action.
The approval instructs staff to record the corrective easement agreement and follow with the already-signed easement documents.
