DuPage County committee approves four zoning variances recommended by Zoning Hearing Officer

DuPage County’s Development Committee approved four zoning relief requests at its May 20 meeting after the Zoning Hearing Officer recommended approval of each application.
The committee approved DCO 18-25 (Smiley), which the Zoning Hearing Officer recommended to permit a corner-side stepback reduction for a new deck from 30 feet to approximately 10 feet and a corner-side stepback reduction for a new front porch from 27 feet to approximately 20 feet. The committee approved the motion by voice vote.
The committee approved DCO 19-25 (Aspen), a conditional use to allow an existing shed to remain less than three feet from the rear property line on the basis that the shed had existed at that location for at least five years. DCO 19-25 passed by voice vote.
DCO 20-25 (Trauth) was approved to permit a reduction of the interior side setback for a new deck from 3 feet to approximately 2 feet to replace an existing deck in the same location. The Zoning Hearing Officer had recommended approval and the committee passed the motion by voice vote.
For DCO 21-25 (Saiz), the committee approved a variance to reduce the corner-side yard setback for a new house built on an existing foundation from 20 feet to approximately 10 feet. Committee member Kyle Rutledge asked why the project needed a variance if work is on an existing foundation. Paul (staff member) explained that the project began as a remodel permit but inspectors found mold in drywall and the removal of the drywall raised the level of improvements; as a result, under the building code the work is treated as a new build and must meet current zoning bulk requirements. Paul said, “So the house is considered a new build under the building code.” The committee approved DCO 21-25 by voice vote after that explanation.
All zoning items were presented as recommendations from the Zoning Hearing Officer and passed with no recorded roll-call votes in the meeting transcript. No amendments to the recommended relief were recorded in the discussion.
The approvals were routine, ministerial zoning adjustments recommended by the Zoning Hearing Officer and confirmed by the Development Committee; committee members did not direct further study or revisions for these items during the meeting.
