Law Director Amanda Deary told council earlier in the meeting that three ordinances related to the annexation were time-sensitive pursuant to Ohio Revised Code 709.023 and were being presented without committee reports. During the floor actions, clerk noted the law director would recuse for later items and Council President led votes.
The ordinances included a provision that Elyria would maintain any segmented road caused by the annexation and a separate ordinance describing services the city will provide to the annexed territory. Council moved and passed the annexation ordinances under suspension of rules without committee reports; the motion was made and seconded by council members during the agenda sequence. No amendments were recorded during the meeting.
Council documents cited Ohio Revised Code §709.023 as the statutory basis for the measures and the law director explained the ordinances were procedural steps needed because an earlier annexation petition had been withdrawn and the new ordinances were substantively identical and time sensitive.
