The Village Board denied an ordinance on May 19 that would have granted a variance from section 9‑3‑6(d) of the Hoffman Estates Municipal Code to permit a corner side yard setback of 4 feet for a storage shed at 760 Orange Lane instead of the minimum 15 feet.
Chairperson Combs reported the Planning and Zoning Commission’s unanimous recommendation to deny the variance. The commission record, as read into the meeting minutes, shows the petitioner sought to place a 150‑square‑foot, 12‑foot‑tall shed in the corner of the lot; nearby neighbors objected, citing safety concerns because the lot sits on a curve near a school and expressing worries the structure would block sight lines and depress neighboring property values.
During board discussion, Corporation Counsel clarified procedural questions about whether a recently passed ordinance affecting vote phrasing had taken effect; board members debated whether motions should be stated in the affirmative. The chair instructed that a yes vote would grant the variance (4 feet) and a no vote would deny it (retain 15 feet).
A motion to approve the variance was made and seconded. In the roll call the clerk recorded no votes by Trustee Stanton, Trustee Arnett, Trustee Palafis and Mayor McLeod; the chair announced the motion to approve the ordinance was denied. The minutes reflect the Planning and Zoning Commission’s recommendation and the board’s decision to deny the variance; no subsequent amendments or conditions were adopted.
