After years of intermittent filings and a request for site-plan materials, the planning board voted to refer case P24‑17 (New State Realty, 404 Main Street) to the town code official for enforcement review.
Town planner Jesse McArthur had submitted a memo dated May 14 outlining the background: the board previously asked the property owner’s representative to supply a site plan for an existing structure that the owner now proposes to use in a commercial manner. McArthur told the board the applicant has not submitted the requested site plan after prior continuances and denials of some waiver requests.
Planning Board Chairman Bill O'Neil and other members discussed whether to send another letter to the applicant’s attorney or to turn the matter over to the code official for enforcement. The board moved to refer the case to the code official and the motion passed; one member (Roger Sampson) recorded an abstention.
No board determination about the substantive zoning status of the existing use was made at the meeting. The referral asks the code official to review compliance and, if necessary, pursue code- enforcement steps such as notice, fines or a cease-and-desist order in accordance with town enforcement procedures.
